Terms and Conditions

Information on how to enter and details of the prizes form part of these Terms and Conditions. By participating, entrants confirm that they have read, understood, and agree to be bound by these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.

  1. Promotion Period: The promotion starts on 06/10/2026 at 10:00 AM AEDT and closes on 29/10/2026 at 11:59 PM AEDT.
  2. Eligibility: Entry is open to Australian residents aged 18 years or over. Employees of the Promoter and their immediate families are not eligible to enter.
  3. How to Enter: To enter, participants must:
    (a) sign up at https://benni.com.au/pages/sign-up-1; and
    (b) follow @benni on Instagram and like the giveaway post.
    Entrants can earn a bonus entry by tagging a friend in the comments of the Instagram giveaway post. Each comment tagging a different friend counts as one bonus entry.
  4. Winner Selection: The winners will be randomly selected by BENNI on 30/10/2026 at 10:00 AM AEDT from all valid entries received during the Promotion Period. The first valid entry drawn will win the First Prize. The next two valid entries drawn will each win a Runner-Up Prize. Each entrant can win only one prize.
  5. Prizes:
    First Prize (1 winner): One original artwork by Lucinda Jones, Love Over Ego. It is acrylic on raw Belgian linen, measures 770 × 1130 mm, and is valued at $3,800 AUD.
    Runner-Up Prizes (2 winners): Each runner-up will receive two looks of their choice from the BENNI Swim collection, valued at up to $400 AUD per winner. A "look" means [one bikini set / one one-piece]. Selections are subject to size and stock availability at the time of redemption.
  6. Winner Notification: Winners will be announced on BENNI's social media on 30/10/2026 and contacted via email. Winners must respond within 7 days of notification to claim their prize.
  7. Unclaimed Prizes: If a winner cannot be contacted or does not claim their prize within the timeframe above, the prize will be forfeited. A redraw will then take place on 10th October at 10:00 AM AEDT at the same location.
  8. Prize Delivery: The prizes will be organised and sent directly to the winners by BENNI, with delivery within Australia at the Promoter's cost. Prizes must be taken as offered and cannot be transferred, deferred, exchanged, redeemed for cash, or sold.
  9. Liability: Nothing in these Terms limits or excludes rights under the Australian Consumer Law. To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage, injury, or other consequences arising from participation in the promotion or use of a prize.
  10. Entry Verification: The Promoter reserves the right to verify entries and disqualify any entrant who does not comply with these Terms, including entries made using fake or duplicate accounts. Failure to enforce any right at any stage does not constitute a waiver.
  11. Technical Issues: The Promoter is not responsible for any technical issues, network failures, or lost, late, corrupted, or misdirected entries. Entries are deemed received once they enter the promotional database.
  12. Promotion Changes: If the promotion cannot run as planned due to unforeseen circumstances, such as technical failures, fraud, or tampering, BENNI may cancel, modify, or suspend the promotion at its discretion, subject to any regulatory requirements.
  13. Final Decision: All decisions by the Promoter regarding the promotion are final. Disputes concerning the conduct of the promotion or claiming a prize will be considered and resolved at the Promoter's discretion.
  14. Privacy: Entrants' personal information will be collected, stored, and used by the Promoter to conduct, administer, and publicise the promotion, in line with BENNI's Privacy Policy. Entrants who sign up agree to receive marketing communications from BENNI and may unsubscribe at any time. Winner information may also be disclosed to relevant authorities as required by law.
  15. Indemnity: Entrants agree to indemnify the Promoter against any loss or damage caused by breaching these Terms and Conditions.
  16. Social Media Disclaimer: This promotion is not sponsored, endorsed, or administered by Instagram, and entrants release Instagram from any liability.
  17. Governing Law: These Terms are governed by the laws of Victoria, Australia. Entrants submit to the non-exclusive jurisdiction of its courts.
  18. Promoter Details: The Promoter is BENNI THE LABEL PTY LTD (ABN 93 665 664 755).
