Terms and Conditions
Information on how to enter and details of the prizes form part of these Terms and Conditions. By participating, entrants confirm that they have read, understood, and agree to be bound by these Terms and Conditions. Entries must comply with these Terms and Conditions to be valid.

  1. Promotion Period: The promotion starts on 23/10/2025 at 10:00 AM AEDT and closes on 03/11/2025 at 10:00 AM AEST.

  2. Eligibility: Entrants must (a) be 18 years or older.

  3. How to Enter: To enter, participants must sign up here: https://benni.com.au/pages/yacht-party-giveaway Extra entries can be earned by commenting on the Instagram giveaway post. There is no limit to the number of entries per entrant.

  4. Winner Selection: The winner(s) will be chosen by BENNI after 03/11/2025. Each winner will receive 2 tickets: one for themselves and one for a guest. In addition, each winner and their guest will receive a BENNI garment of their choice from our unreleased collections. Two winners will be selected in total.

  5. Event Location: Please note that this event will take place in Sydney, NSW. If you are located interstate, you will be required to cover your own travel and accommodation costs.

  6. Winner Notification: Winners will be announced on BENNI’s social media and contacted via Instagram DM and/or email.

  7. Prize Delivery: The prize will be organised and sent directly to the winner by BENNI. Prizes must be taken as offered and cannot be transferred, deferred, exchanged, redeemed for cash, or sold. If any component of a prize is unavailable, the Promoter may substitute it with a prize of equal or greater value.

  8. Liability: Nothing in these Terms limits or excludes rights under Australian Consumer Law. To the maximum extent permitted by law, the Promoter is not responsible for any loss, damage, injury, or other consequences arising from participation in the promotion or use of the prize.

  9. Entry Verification: The Promoter reserves the right to verify entries and disqualify any entrant who does not comply with these Terms. Failure to enforce any right at any stage does not constitute a waiver.

  10. Technical Issues: The Promoter is not responsible for any technical issues, network failures, or lost, late, corrupted, or misdirected entries. Entries are deemed received once they enter the promotional database.

  11. Promotion Changes: If the promotion cannot run as planned due to unforeseen circumstances (e.g., technical failures, fraud, tampering), BENNI may cancel, modify, or suspend the promotion at its discretion, subject to any regulatory requirements.

  12. Final Decision: All decisions by the Promoter regarding the promotion are final. Disputes concerning the conduct of the promotion or claiming a prize will be considered and resolved at the Promoter’s discretion.

  13. Privacy: Entrants’ personal information will be collected, stored, and used by the Promoter to conduct, administer, and publicise the promotion, in line with BENNI’s Privacy Policy. Winner information may also be disclosed to relevant authorities as required by law.

  14. Indemnity: Entrants agree to indemnify the Promoter against any loss or damage caused by breaching these Terms and Conditions.

  15. Social Media Disclaimer: This promotion is not sponsored, endorsed, or administered by Instagram, and entrants release Instagram from any liability.

  16. Governing Law: These Terms are governed by the laws of Victoria, Australia. Entrants submit to the non-exclusive jurisdiction of its courts.

  17. Promoter Details: The Promoter is BENNI THE LABEL PTY LTD (ABN 93 665 664 755).
